GUIDELINES

Secondary Creation Guidelines

HeartSync LLC (hereinafter referred to as "the Company") has established the following guidelines to ensure that more people can safely enjoy the content we provide, such as characters, still images, videos, designs, etc. (hereinafter referred to as "Company Content") and to contribute to the development of the industry as a whole. We ask that you conduct your secondary creative activities with respect toward the Company, our creators, distributors, and fans, while adhering to these guidelines. If you comply with these guidelines, you do not need to contact us regarding your secondary creations.

What is Secondary Creation?

"Secondary creation" refers to works created using Company Content that incorporate original ideas and creativity. If your work complies with these guidelines, we will not exercise our rights over it in principle.However, works that use Company Content without any substantial change or that lack creative originality (e.g., simple modifications) do not qualify as secondary creations and are not covered by these guidelines.

Usage Restrictions

Please enjoy secondary creations within the scope of hobby-based or fan activities. The following uses are prohibited:

● Expressions that significantly damage the image of affiliated talents or third parties
● Content that undermines the trust, dignity, honor, or rights of talents or others
● Inappropriate or malicious alterations
● Content against public order or morals
● Violations of laws or expressions that encourage illegal behavior
● Discriminatory content based on race, nationality, gender, religion, etc.
● Excessively violent or cruel expressions
● Misleading representations that make secondary creations appear official
● Any other content the Company deems inappropriate

Sales of your derivative works are permitted at an individual level that is directly within the scope of your hobbies such as selling artwork and crafts. If the Company notices the level of sales or production of your derivative works extend past that of a fan level the Company will request that you stop production of derivative works from then on.


Use of Secondary Creations

Secondary creations that are made public may be used by the Company and affiliated talents for thumbnails, social media, etc.—freely, anytime, anywhere, and without compensation. Additionally, by publishing your work, you are deemed to have agreed that it may be translated, modified, or edited, as long as the original image of the work is not significantly harmed.

We believe that promoting and supporting secondary creative activities contributes greatly to the growth of the industry. We hope you enjoy engaging in secondary creation freely and within the scope of these guidelines.

Clipping Guidelines

We welcome the creation and posting of clipping videos (edited segments from our streams or videos) by our viewers. We appreciate your efforts to spread awareness of our channel. However, to protect the image of our talents and intellectual property rights, we have established the following guidelines. Please read them carefully and comply. These guidelines are applied in conjunction with the Secondary Creation Guidelines.


Prohibited Activities

The following are not allowed:

● Clipping content from paid content, such as members-only videos or ticketed livestreams (unless explicitly permitted)
● Using misleading or false titles or thumbnails
● Content that defames or slanders talents or third parties, or violates public order
● Registering clipping videos as your own copyrighted content (e.g., Content ID registration)
● Uploading streams or videos without any edits (i.e., full re-uploads)

※ Clipping videos must be edited or restructured excerpts from the original.


Posting Guidelines

Please observe the following when uploading clipping videos:

● Do not post clips before the original stream archive is publicly available
● In the video description (at the beginning), include:
○ The title of the original video
○ The URL of the original video

If we determine that the content or thumbnail of a clip is inappropriate, we may request deletion or take other action at our discretion. Please understand this in advance.


Monetization

As long as you follow the guidelines, you may monetize your clipping videos without prior approval. You are free to use monetization features offered by platforms such as YouTube Partner Program. However, please be aware of the following:

● Do not violate the platform's terms of service, or use any third-party content in the
original video without permission
● Do not register clipping videos with automated identification systems (e.g., Content ID)
